The mother of a teenager from South Carolina who was forced to remove his make up for his driver's license photograph has filed suit against Department of Motor Vehicles. The suit was filed in federal court in South Carolina by the New York-based Transgender Legal Defense and Education Fund on discrimination based on sex stereotypes.

Chase Culpepper, 16, was told by one of the DMV officials that he needs to remove his mascara and eye shadow before taking his picture. According to Culpepper, however, he was humiliated when he was later told that he had not removed enough. The Transgender Legal Defense and Education Fund has sent a letter acquiring the DMV officials to retake Culpepper’s picture while wearing the makeup.

DMV has yet to release a statement on the matter.
