Benghazi Suspect Will Be Tried In Criminal, Not Military Court

Libyan militant Ahmed Abu Khatallah, a suspected leader of the 2012 attack on the U.S. diplomatic compound in Benghazi, will be tried in the criminal justice system, reports Reuters.

Upon his arrival to the United States, Khatallah will be arraigned like any other domestic defendant. He will enter a plea, face the possibility of a bond, and be allowed to appoint counsel for his defense. 

This approach to the prosecution of a suspected terrorist is markedly different from that taken during the Bush administration, when such individuals were taken directly to military prisons. 

Official charges against him include killing a person on U.S. property, a firearms violation, and providing material support to terrorism.  

Khatallah was captured last Sunday in a military raid and is currently being transported to the U.S. by ship.
