Judge To Rule On Same-Sex Marriage In Ohio

A federal judge said on Friday he will issue a ruling on April 14 to allow same-sex marriages from other states to be recognized in Ohio, according to The Daily Beast.

U.S. District Court Judge Timothy Black said the ruling does not strike down Ohio's ban on same-sex marriage. Ohio has a 10 year ban on same-sex marriage. Judge Black's ruling will prohibit officials from enforcing the ban that does not recognize the marriages, says NBC News.

The ruling came into light after Black spoke during a case brought by three lesbian couples who challenged Ohio's refusal to recognize their names on their children's birth certificates, says Daily Beast.

Al Gerhardstein, the lead counsel in the case, said, "The freedom to marry is not in 17 states and D.C. Ohio should recognize these marriages are equal in every respect to the out-of-state marriages of opposite-sex couples." 

Black's ruling will not force Ohio to permit same-sex marriage. However the ruling is a step towards marriage equality.

Attorney General Mike DeWine said he will appeal the ruling once it is filed, according to The Columbus Dispatch. However he recognizes that the point of the ruling is to help same-sex couples marriage rights be respected in Ohio, not legalize same-sex marriage. 

"There is no order that tells 'Ohio, you have to start marrying people.' The key is what he says in his order. Until we see the order, we don't know the breadth of it or the narrowness of it," said DeWine.

The case will go up to the 6th Circuit in the U.S. Court of Appeals.
