The Washington D.C. City Council voted 10-1 to decriminalize marijuana, lowering the potential one-year jail sentence for possession of less than one ounce to a $25 fine.

But smoking the drug is still a crime; offenders can receive up to six months in jail. D.C. lawmakers said they do not intend to encourage pot use, but are instead trying to reduce racial profiling in arrests.

Also, police officers cannot make an arrest based on smelling the drug, they have to be able to see smoke. And being under the influence in public is still not a crime, unless the user is driving a car.
