Utah Legalizes Same-sex Marriage

A federal judge in Utah ruled the same-sex marriage ban unconstitutional on Friday, on the basis that it violates a guarantee of equal protection under the law.

 

Judge Robert J. Shelby said that the state had failed provide evidence that same-sex marriages would have any affect on opposite-sex marriages.

 

But Peggy Tomisic, the lawyer representing the plaintiffs, three gay and lesbian couples, said the state was likely to appeal the case.

 

Indeed, lawyers representing Utah argued that the ban encouraged “responsible procreation, and the “optimal mode of child-rearing.”

 

But Tomsic also said she believes the new ruling will stand in the end.
