The third-largest national cinema chain received the lawsuit on Friday, the same day the company revealed the plan to refurbish the theater for re-opening in 2013.

Denise Traynom, Brandon Axelrod and Joshua Howlan claim that theater had inadequate security. They said that there was no security guard on duty and the alarms.

"Readily available security procedures, security equipment and security personnel would likely have prevented or deterred the gunman from accomplishing his planned assault on the theater's patrons," attorney Christian Habas, who represents the three victims, said in a news release.

The lawsuit also claims that the victims did not receive assistance to evacuate the movie theater. The lights were off or low, says Reuters.

Traynom was wounded in the buttocks, while Axelrod suffered bone injuries to his right knee and ankle. Nowlan's right arm was nearly severed by a bullet, and he was also wounded in the leg, accord to Fox News.

Cinemark had known of previous incidents at the theater, including another shooting and several assaults and robberies, reports Bloomberg.

James Holmes, 24, is charged with killing 12 people and wounding 58 other during a midnight showing of "The Dark Knight Rises."
