Marvin Wilson, convicted of killing a police informant in 1992, was executed Tuesday evening by lethal injection at the state prison in Huntsville. His attorneys had unsuccessfully tried to appeal to the high court so that Wilson would be ineligible for capital punishment because of his low IQ score. Wilson scored a 61 in a psychological test conducted in 2004. In Texas, the minimum score to be considered mentally competent is 70.  

The Associated Press reported that the courts denied Wilson's appeals and upheld the sentence because they argued that "Wilson's mental impairment claim isn't supported by other tests and assessments of him."
