Prop 8 Supporters Ask For Supreme Court Review

Gay marriage opponents asked the U.S. Supreme Court Tuesday to overturn a federal appeals court decision that ruled Proposition 8 unconstitutional. The voter-approved measure that banned same-sex marriage was passed in 2008, before it was struck down in February.

According to the LA Times, Protect Marriage's lead attorney, Charles J. Cooper, said he believes the High Court will hear the case. Supporters of Prop 8 all fight under the ProtectMarriage.com banner and include over 500-plus in a petition.

“The Supreme Court has made it very clear that the age-old definition of marriage as the union of one man and one woman is constitutional as a matter of state public policy,” Cooper said. “The lower court decisions essentially rejected all relevant Supreme Court and appellate court precedent while attacking the character and judgment of millions of Californians.”

The justices will decide in the next few weeks whether or not they'll grant the review. The case will determine whether the 14th Amendment's "equal protection" clause prevents states from limiting marriage to one only between a man and woman, reported CNN.

If the Supreme Court takes on the case oral arguments are expected to begin early next year.
