A U.S. District Judge, Daniel Jordan, ruled that the only abortion clinic in Mississippi can remain open, although the abortion law that would have forced the clinic to close will take effect.

The law, passed by the Republican-controlled legislature, set up new requirements for the clinic. Anyone who performs abortions at the clinic would have to be an OB-GYN with privileges to admit patients to a local hospital; neither of the clinic’s OB-GYN’s have those privileges. So, the judge gave the clinic more time to comply with the new requirements.

The judge ruled that while the law would be upheld, the clinic cannot face civil or criminal punishment while working toward meeting the requirements of the law.

Meanwhile, the constitutionality of the law is still being challenged. Pro-choice activists have declared the law an attempt to ban abortion in Mississippi.
