Lindsay Lohan: Probation Revoked, Could Face Jail Time After Hearing

Lindsay Lohan is out of jail after posting $100,000 bail from her revoked probation status Wednesday, but she now faces a probation violation hearing in two weeks that could send her to jail for up to 18 months.

Calling probation a gift, L.A. County Superior Court Judge Stephanie Sautner found sufficient evidence to remove Lohan’s probation status pending a probation violation hearing on November 2. The 25-year-old actress was terminated from a program at the Downtown Women’s Center after missing several appointments. 

Sautner was also unimpressed with how few of the 360 mandated community service hours at the center and 120 hours at the morgue had been completed – just 21 at the skid row shelter. After her removal from the women’s center, Lohan tried switch her hours to the American Red Cross. Lohan has until April 2012 to complete her requirements. 

Prosecutors will be asked to present witnesses at the hearing to explain the breakdown between Lohan and the Downtown Women’s Center and to provide details about her court-ordered weekly psychological counseling sessions.   

Lohan was on probation for two DUI charges, a reckless driving charge, a diversion program instead of a cocaine possession charge, and a misdemeanor theft charge. Her attorney Shawn Holley tried to argue that people are rarely perfect when serving probation. However, an irate Sautner seemed fed up with Lohan’s behavior.

“How many stumbles have there been on the Beverly Hills case?” she asked Holley. “Her probation would have been over last year, had she done what was expected of her.” 

Sautner also issued an admonition to Lohan, saying that if she wanted to “mitigate any potential sentence,” she should complete at least 16 hours of her 120 mandated community service hours at the morgue before the court date.

Sautner said that it was unlikely that Lohan will be thrown in jail due to the growing number of felons residing there. A controversial new law allows prisoners who commit nonviolent and non-sex-related crimes to be kept in county jails rather than state facilities. “The jails are going to be filled with felons,” the judge said.

Lohan defended herself in a post on her Twitter account. “I just want it to be known, that just because I was not followed & photographed during the times I've gone to community service, does NOT mean that I wasn't following my obligations (by going) to the court,” she wrote.
