Affordable Care Act Struck Down By Second Federal Court
Comments (0)
Surpassing the first judicial review of the health care law signed into law last spring, a federal judge in Florida ruled Monday that the entire Patient Protection and Affordable Care Act is unconstitutional because of requirement that all Americans purchase health insurance by 2014.
A judge in Virginia said in the fall that only the individual mandate is unconstitutional. Two other federal judges--President Bill Clinton-appointees in Michigan and Florida--have said the mandate is okay. And there's still one lawsuit outstanding in Oklahoma.
The legal variance means the health care law is likely to be eventually heard by the U.S. Supreme Court.
